TERMS OF USE ("TOU") for vkspotter.com
1. Acceptance of terms of use and amendments
Each time you use or cause access to vkspotter.com, you agree to be bound by these TOU, as amended from time to time. Any amendments may be published in the System Notices section of the "vkspotter.com.
2. Your responsibilities and registration obligations
In order to use vkspotter.com, or parts of it, you may be required to register a user account(s).
By registering a user account(s) with vkspotter.com, or any future resource made available on vkspotter.com, you explicitly agree to these TOU, including any amendments made by the Administrator of vkspotter.
If you have registered an account by accident, or do not agree to the TOU, please contact the administrator (by emailing webmaster@vkspotter.com ), requesting that your account(s) be deleted.
3. Privacy policy
You acknowledge that you are making some information about yourself available to the public.
This information includes, but is not limited to, your callsign, first name, email address, and location. You may also choose to provide other non-mandatory information about yourself.
This information is collected so that other users can generally engage in activities involving amateur radio and/or the internet.
You acknowledge that, by default, your email address may be visible to the public.
4. Registration and password
You are responsible for maintaining the confidentiality of your password, and you will be responsible for all usage of your user account and/or user name, whether authorised or not authorised by you.
5. Your conduct
You agree that all information or data of any kind, whether text, software, sound, or image files ("content"), made available publicly or privately, will be under the sole responsibility of the person providing the said content.
You agree that this web site may expose you to content that may be objectionable or offensive.
The Administrator of vkspotter.com, the Administrator's representatives, and partners will not be responsible to you in any way for content displayed on vkspotter.com, nor for any error or omission. This includes, but is not limited to the "vkspotter.com".
6. By using vkspotter.com, you explicitly agree that:
(a) you will not provide any content or conduct yourself in any way that may be construed as: unlawful; illegal; threatening; harmful; abusive; harassing; stalking; defamatory; libelous; vulgar; obscene; offensive; objectionable; pornographic; designed to interfere with or disrupt the operation of this web site or any service provided; infected with a virus or other destructive or deleterious programming routine; giving rise to civil or criminal liability; or in violation of an applicable local, national or international law;
(b) you will not impersonate or misrepresent your association with any person or entity; you will not forge or otherwise seek to conceal or misrepresent the origin of any content provided by you;
(c) you will not collect or harvest any information about other users;

You agree to indemnify and hold harmless the Administrator of vkspotter.com and the Administrator's representatives, and partners from any claim or demand, including reasonable legal fees, that may be filed by any third party, arising out of your conduct or connection with this web site, your provision of content, your violation of these Terms of use, or any other violation by you of the rights of another person or party.
8. Applicable Laws
Use of vkspotter.com and these Terms and Conditions
are governed by the laws of the State of New South Wales, within the
Commonwealth of Australia. Any claim relating to use of vkspotter.com
shall be heard by New South Wales Courts. If you choose to access
this site from a location outside of Australia, you do so on your own
initiative and are responsible for compliance with applicable local
laws.
